   Triple thanks:1st for making a statistics out of the pdf that early2nd for making me feel better about not passing C. After all, I got a solid PASS for my performance in D. There, I did better than 73% of the candidates. 3rd for the Q&A books on D which are an important reason for my performance in this part.A Physicist from Germany

   I also thank you for the statistics. As for papers A, C and D you have included also the 0 score – how would the charts look if the 0 score was filtered out (i.e. so that only non-zero scores were taken account for)? This would be a more "true" indication of how the candidates actually sitting the papers scored since candidates with the score 0 in most cases did not even show up…On a second note it would also be interesting to see the pass rate if the bar was set to 50p (instead of 45p). The motivation behind this is that you in any case need at least 50p on two papers in order to pass.2011 Candidate

   Is the possible to appeal the result? On what basis? I have been so close now for 2 years, one and two marks behind the pass level.

   I assume you mean in the 40-44 point range?An appeal is theoretically possible – see REE, Article 24 (page 17-18)/ R.9 (page 25)(http://archive.epo.org/epo/pubs/oj011/03_11/03_sup11.pdf), but is it worth it?- You only have 2 months from notification (date + 10 days) of your official letter to file a notice and grounds- It costs 6x 130 = 780 Euros- If the Exam. Board does not immediately change their decision (most cases), you will only get a decision after March 2012, so after the next EQE- to win the appeal, you must show that the Examination board & committees did not follow their procedures- you cannot win on subjective arguments (e.g. my answer is better than the one on the compendiumThe chances of success are very small – past decisions (Dxx/xx cases) can be found in the EPO Board of Appeal databaseThe appeals that we see won are the ones based on pages marked out of sequence, pages not marked. Things like that.I would suggest waiting until you have your marking sheet (points for each question), and comparing your answers with the Examiners Report to look for differences. If your answers are similar but you got fewer points, then it may be worth it.If your answers are completely different and rather unlikely; or you are not writing enough; then it is probably not worth it.
